The Constitutional requirement for a pinky swear

A senator lives where he or she says they live

Apparently these questions are easily answered.

Marjory LeBreton, government leader in the Senate, says the legal advice they received is that signing a declaration of qualification form that says he is from the island is all it takes. “There is no doubt that senators that sit in the Senate, by way of the declaration of qualification, qualify to sit in the Senate,” LeBreton said.

So, as far as the Senate is concerned, as long as you sign a declaration indicating that you are a resident of somewhere, you are a resident of there. Maybe that’s why the Prime Minister was comfortable declaring that all senators met the constitutional residency requirement.

The Constitutional requirement for a pinky swear

  1. Holy ****. Because I say I’m a resident, I’m a resident? That should really help with our immigration problem.

Oh, and somebody tell the provinces with residency wait-times for health care that, well…things just changed.

  2. Look up the qualifications for being PM.

  3. “There is no doubt that senators that sit in the Senate, by way of the declaration … ”

John 8:32 – And ye shall know the truth, and the truth shall make you free

  4. I would say there is quite a bit of doubt. Need I even point out this does not pass any sort of smell test?

  5. “We will now hear from the Senator from Mars.”

Also, I think I’ll pinky swear to being a resident of Alberta so’s I can pay lower income tax. I have lived there in the past, so it could be true. In the fantasyland that is the Senate, anyway.

  6. ‘When I use a word,’ Humpty Dumpty said, in rather a scornful tone, ‘it means just what I choose it to mean — neither more nor less.’

  7. This seems entirely, and unequivocally, wrong.

  8. Perhaps *Senator LeBreton might consider obtaining a REAL legal opinion from a REAL lawyer with a REAL law degree licensed to be a member of a REAL law society instead of from a mailroom clerk in the PMO who signed a declaration. Just a thought.
